PARTIES This Event Service Contract ("Contract") is entered into between The Crafty Corner LLC ("Company") and the undersigned client ("Client"). 2. EVENT DETAILS Client Name, Event Date, Event Start Time, Event Location, Party Package (Standard $195 / Deluxe $260 / Premium $330), Number of Children / Guests, Travel Fee (calculated from Gadsden, Alabama, per the schedule on our website, if any). The travel fee is based on your event address and will be confirmed before your event. If the travel tier selected doesn't match the event address, the correct tier applies to your balance. 3. SERVICES PROVIDED The Company provides mobile teddy bear parties: we bring the party to you — bears, stuffing, and all activity materials — set up, run the activity, and clean up our materials afterward. The package price covers the number of children stated in Section 2. Additional children are $15 each, payable by card before the activity begins, and can only be added if the Company has materials available. 4. PAYMENT TERMS - A non-refundable deposit of 50% of the total booking amount (package price plus any travel fee combined) is required to secure the event date. The event date is not reserved until the deposit is received. - The remaining balance is due 7 days before the event. A payment link will be sent to the Client; the balance must be paid by card through that link no later than 7 days before the event date. If the balance is not paid in full by that date, the Company may cancel the booking and the deposit will be forfeited. - Accepted payment method: credit/debit card, as listed on our website (thecraftycorner.org). 5. CANCELLATION & DATE CHANGES - Deposits are non-refundable. - Cancellations made 14 or more days before the event may receive credit toward a future booking. - Cancellations within 14 days of the event are fully non-refundable, including the balance if already paid. - One date change requested 14 or more days before the event may be applied as credit toward a future booking, subject to availability. - If the Company must cancel the event and no reschedule date is agreed, all payments made, including the deposit, will be refunded in full. 6. SETUP, SPACE & TIMING - The Client will provide a clean, flat, covered area large enough for the activity and access to the space at the agreed setup time so the Company can set up before guests arrive. - If the event starts late due to the Client or guests, the service will still end at the agreed end time; time lost cannot be added to the end of the event. 7. CLIENT RESPONSIBILITIES The Client agrees to: - Provide accurate event details. - Provide the final headcount at least 7 days before the event. - Ensure a safe, clean environment for the event. - Supervise minors at all times. The Company does not provide childcare and is not responsible for supervising children. - Inform the Company of any allergies or special needs before the event. - Tell their guests that The Crafty Corner may take photos and video at the event for promotion (see the Waiver below), and let the Company know before the event if any child must not be photographed or filmed. - Communicate any changes at least 7 days prior to the event. 8. COMPANY RESPONSIBILITIES The Company agrees to: - Arrive on time with all required materials. - Provide professional, engaging services. - Clean up Company materials after the event. 9. EQUIPMENT & DAMAGE The Client is responsible for any damage caused by the Client or guests to Company equipment and materials, including but not limited to the stuffing machine, craft tools, and party materials, and agrees to pay the reasonable cost of repair or replacement. 10. FORCE MAJEURE The Company is not responsible for delays or cancellations caused by weather, illness, emergencies, or circumstances beyond its control. In such cases the Company will work with the Client to reschedule, and payments already made will be applied as credit toward the new date. 11. WAIVER INCORPORATED The Liability Waiver & Assumption of Risk Agreement signed together with this Contract is part of this agreement. If any part of this Contract is found unenforceable, the rest remains in full effect. This Contract is the entire agreement between the parties for this event; any changes must be agreed in writing (text or email is fine). This Contract is governed by the laws of the State of Alabama. 12. SIGNATURES By signing, the Client agrees to all terms of this Contract. MOBILE TEDDY BEAR PARTY — LIABILITY WAIVER & ASSUMPTION OF RISK AGREEMENT 1. PURPOSE This Liability Waiver and Assumption of Risk Agreement ("Agreement") covers all mobile teddy bear party activities provided by The Crafty Corner LLC, including bear stuffing, dressing and decorating bears, and related craft activities, for the Client, the Client's children, and all guests who participate. 2. ASSUMPTION OF RISK The Client understands that participation may involve risks, including: - Use of the stuffing machine, scissors, and craft tools - Contact with fabrics, stuffing, dyes, adhesives, and craft supplies - Allergic reactions to materials - Slips, trips, falls, or minor injuries during the activity The Client, on behalf of themselves, their children, and their guests, voluntarily assumes all risks associated with participation. 3. RELEASE OF LIABILITY The Client agrees to release, waive, and discharge The Crafty Corner LLC, its owners, employees, and representatives from any and all claims, demands, or causes of action arising from ordinary negligence connected with participation in the activities. This release does not cover gross negligence, reckless conduct, or intentional harm. The Client agrees not to sue the Company for any claim covered by this release. 4. INDEMNIFICATION The Client agrees to indemnify and hold harmless The Crafty Corner LLC, its owners, employees, and representatives from any claims, damages, losses, or expenses (including reasonable attorney's fees) brought by the Client, the Client's children, guests, or anyone on their behalf, arising from participation in the activities or from the actions of the Client or guests at the event — except where caused by the Company's gross negligence or intentional harm. 5. CLIENT RESPONSIBILITIES The Client agrees to: - Supervise minors at all times - Ensure the event space is safe and free of hazards - Inform the Company of allergies or special needs before the event - Follow all safety instructions - Stop any participant who is using tools or materials unsafely 6. MEDICAL AUTHORIZATION If a participant is injured, the Company may provide or seek basic first aid and, in an emergency, call 911. The Client is responsible for any medical costs. The Client confirms they have told the Company about any allergies or medical conditions relevant to the activities. 7. PHOTO & VIDEO The Company may photograph and record the event — the setup, the bears, and the activities — and use the photos and video to promote The Crafty Corner (social media, website, and advertising). The Client agrees to tell their guests that filming may happen. Any parent or guardian who does not want their child photographed or filmed may say so before or at the event, and the Company will keep that child out of photos and video, or remove them from footage on request. 8. MINOR PARTICIPATION & SIGNER AUTHORITY Alabama's age of majority is 19. A parent or legal guardian must sign for any participant under 19. By signing, the signer confirms they are the parent or legal guardian of the minors listed, or have the authority to sign on their behalf. 9. SEVERABILITY & GOVERNING LAW If any part of this Agreement is found unenforceable, the rest remains in full effect. This Agreement is governed by the laws of the State of Alabama. 10. ACKNOWLEDGMENT & SIGNATURE The travel fee is based on your event address and will be confirmed before your event. If the travel tier selected doesn't match the event address, the correct tier applies to your balance. By signing, the Client acknowledges they have read and understand this Agreement.
